The Process: Step-by-Step
- Attorney and VBA complete and sign the Service Agreement.
- VBA sends a copy of the necessary forms to the attorney (including a Client Questionnaire), or the Attorney can download the forms directly from our website.
- Attorney meets with the Client and reviews the Client Questionnaire to make sure all pertinent information is provided.
- Attorney faxes or emails to the VBA the Client Questionnaire and all documents required in the Service Agreement.
- VBA enters all the information from the Client Questionnaire into the licensed Best Case Bankruptcy software.
- VBA assists the Attorney with Due Diligence and does all necessary research to insure the data and figures provided by the Client are correct. This includes but is not limited to;
- Nationwide Bankruptcy online searches for each debtor.
- Online searches for property, liens and civil records.
- Home valuations through zillow.com
- NADA and Kelly Blue Book research for current vehicle, vessel and motorcycles values.
- VBA provides the Attorney a draft of the Petition for their review, usually within 48 hours, along with a Cover Letter addressing any potential problems, such as missing information, un-exempt equity or valuation issues.
- If Attorney chooses, VBA contacts the Client to clear up any issues or concerns with the information provided by the Client.
- We have been trained in Unauthorized Practice of Law (UPL) regulations. We do not provide legal advice to your clients. We will only gather general information for Attorney's review and directions. Any questions asked by the clients during calls will be written down, emailed to Attorney and a copy will be placed in the Client's file.
- VBA makes the necessary changes to the Petition, Schedules, Means Test and Statement of Financial Affairs and submits it to the Attorney for Review.
- Attorney reviews the Petition and all other documents. Once the Attorney is satisfied with the petition, the VBA finalizes it.
- VBA electronically files the completed Petition or sends a copy of the Petition for Attorney or Attorney's staff to file.
- All Petitions contain the Attorney's name, Law Firm, Bar number and contact information. The Virtual Bankruptcy Assistant's information does not appear anywhere on the documents.
- VBA submits an invoice to the Attorney which can be paid online, by check or credit card authorization.
